American installers still at risk

After President Biden's intervention on tariffs on imports from certain South-East Asian countries, the US solar industry continues to suffer delays due to

imports blocked by customs because they might contain silicon manufactured by Hoshine in Xinjiang.

A legal challenge to Biden's decision (to waive customs duties) would be difficult because of the time constraints. This demand for panels has been exacerbated by the risk posed by the Department of Commerce's AD/CVD investigation. This challenge would take some time to process, while most manufacturers are now out of stock until the end of 2022, some until 2023 and even 2024.

There is good news for developers, EPCs and other importers: any potential legal challenge to the President's action should be decided within the two-year time limit.
