Appeal to the Council of State against the 2006-2010 tariff revision

The texts (decree n°2021-1385 of 26 October 2021 and order of 26 October 2021) call into question the economic sustainability of the producers to whom they apply and seriously and immediately undermine their financial and patrimonial interests. These texts also degrade the conditions of financing the production of electricity from renewable sources and seriously and immediately undermine the public interest in the development of renewable energies and the respect of the State's climate commitments. These infringements fully justify the suspension of these texts.

The owners of solar power plants affected by the tariff revision for pre-2011 installations have received this week their notification with the new tariff. As of this evening, they can activate the safeguard clause on the ReCOST platform set up specially by the Energy Regulatory Commission. The tariff cuts are very heterogeneous. Some are as low as -90%.
